Alaska v. United States Department of Agriculture
ELR Citation: 43 ELR 20068 No(s). 11-1122 (D.D.C. Mar 21, 2013) (Leon, J.)
A district court dismissed as untimely Alaska's lawsuit challenging the 2001 roadless rule, which prohibits roadwork and timber harvesting on 58.5 million acres of national forest, including 14.7 million acres of the Tongass and Chugach National Forests in Alaska. Alaska's cause of action accrued in January 2001, when the roadless rule was adopted and published. As such, the six-year limitations period expired well before Alaska instituted the present action in 2011.
