An EPA administrative law judge (ALJ) granted a processing plant’s motion to supplement their prehearing exchange in a case alleging that they operated a hazardous waste storage and treatment facility in Illinois without a RCRA permit. The ALJ also granted EPA’ motion to revise the proposed penalty amount $743,293 to $120,000 based upon the plant’s inability to pay.
