An administrative law judge (ALJ) holds a manufacturer liable for failing to make a hazardous waste determination for waste paint ash generated from the burning of waste paint off of paint hooks. A Resource Conservation and Recovery Act screening inspection occurred at the manufacturer's facility in 1997 during which the U.S. Environmental Protection Agency (EPA) informed the manufacturer that it had not made a hazardous waste determination for the ash.
