An administrative law judge (ALJ), granted motions filed by the EPA and the defendant for an extension of time to file the complaint's proposed penalty calculation for Count I; the extension of time is until August 15, 2005. Because both parties successfully reached an agreement in principle to resolve the defendant's liability for the violations alleged in Counts I-IV the parties state that was good cause to grant the extension.
