Illinois: Water

The Environmental Protection Agency adopted amendments to regulations governing procedures for issuing loans from the Water Pollution Control Loan Program. The amendments allow 30-year loans to all loan recipients, add the definition of the Build America Buy America Act, and clarify that loan applicants will need to comply with the Act’s requirements where applicable.

Florida: Climate Change

The Department of Environmental Protection proposed amendments to regulations governing the Sea Level Impact Projection (SLIP) study. The amendments would, among other things, expand the scope of the SLIP study requirements for state-financed construction projects located within areas at risk due to sea-level rise and establish a “significant flood damage” threshold for potentially at-risk structures or infrastructure Comments are due April 11, 2024.

California: Waste

The Department of Resources Recycling and Recovery proposed amendments to regulations governing dealer registration and dealer cooperatives. The amendments would integrate dealer cooperatives into Chapter 5 by, among other things, defining terms, establishing registration processes, outlining redemption requirements, establishing processes for stewardship plans, and establishing enforcement measures. A hearing will be held April 30, 2024. Comments are due the same date.

Alaska: Water

The Department of Environmental Conservation proposed to reissue, without amendments, the Alaska Pollutant Discharge Elimination System general permit for facilities related to oil and gas exploration, production, and development in the North Slope Borough. The permit would reauthorize discharges from graywater, gravel pit dewatering, excavation dewatering, hydrostatic testing, stormwater, mobile spills response, and contained water. Comments are due April 19, 2024.

Maryland: Governance

The Department of the Environment adopted new regulations governing the Marine Contractors Licensing Board. The regulations establish, among other things, four tiers or categories of marine contractor licenses.

Virginia: Water

The State Water Control Board amended and reissued the Virginia Pollutant Discharge Elimination System general permit for discharges of stormwater associated with industrial activity.

Vermont: Waste

The Department of Environmental Conservation proposed amendments to regulations governing above-ground storage tanks. The amendments would add requirements for new tank system installations, phased-in requirements for existing systems, and a new provision allowing limited fuel deliveries to noncompliant tanks via a yellow tag system, while also clarifying rule applicability, providing new technical definitions, and changing the tank inspection interval from 3 to 4 years.

Pennsylvania: Water

The Department of Environmental Protection announced the availability of a draft NPDES general permit for discharges of stormwater associated with construction activities. Comments are due April 8, 2024.

Ohio: Governance

The Environmental Protection Agency proposed amendments to regulations governing agency procedures as part of a five-year review. The amendments would remove unnecessary restrictions, correct citations, and address minor typographical errors. Comments are due April 19, 2024.

New Hampshire: Waste

The Department of Environmental Services proposed to readopt, without amendments, regulations governing solid waste at incineration facilities. The regulations specify requirements for waste incineration facilities, management of various waste types such as asbestos and infectious waste, certification of waste-derived products, implementation of the voluntary wood ash spreading program for agricultural use, regulation of heavy metals in product packaging, and inspection protocols for solid waste facilities. A hearing will be held April 4, 2024. Comments are due April 11, 2024.
