The State Water Control Board amended and reissued the Virginia Pollutant Discharge Elimination System general permit for discharges of stormwater associated with industrial activity.
The Department of Environmental Conservation proposed amendments to regulations governing above-ground storage tanks. The amendments would add requirements for new tank system installations, phased-in requirements for existing systems, and a new provision allowing limited fuel deliveries to noncompliant tanks via a yellow tag system, while also clarifying rule applicability, providing new technical definitions, and changing the tank inspection interval from 3 to 4 years.
The Department of Environmental Protection announced the availability of a draft NPDES general permit for discharges of stormwater associated with construction activities. Comments are due April 8, 2024.
The Environmental Protection Agency proposed amendments to regulations governing agency procedures as part of a five-year review. The amendments would remove unnecessary restrictions, correct citations, and address minor typographical errors. Comments are due April 19, 2024.
The Department of Environmental Services proposed to readopt, without amendments, regulations governing solid waste at incineration facilities. The regulations specify requirements for waste incineration facilities, management of various waste types such as asbestos and infectious waste, certification of waste-derived products, implementation of the voluntary wood ash spreading program for agricultural use, regulation of heavy metals in product packaging, and inspection protocols for solid waste facilities. A hearing will be held April 4, 2024. Comments are due April 11, 2024.
The Department of Environmental Quality proposed to adopt amendments to regulations governing water quality. The amendments would, among other things, revise provisions pertaining to groundwater mixing zones, nondegradation of water quality, criteria for determining nonsignificant changes in water quality, and criteria for nutrient reduction from subsurface wastewater treatment systems. A hearing will be held April 23, 2024. Comments are due the same date.
The Department of Agriculture, Conservation, and Forestry adopted new rules governing the implementation of certain strategies identified in the PFAS Fund Plan. The rules establish eligibility criteria, administrative procedures, evaluation criteria, and appeals procedures for a number of programs. The Energy and Carbon Management Commission adopted amendments to regulations governing rules of practice and procedure. The amendments revise the 100 Series definition of “high priority habitat” to amend certain high priority habitat maps in Appendix VII. The Department of Public Health and Environment adopted amendments to regulations governing composting at solid waste sites and facilities. The amendments increase allowable Type 2 feedstock volumes for conditionally exempt small quantity facilities, permit certain Class I facilities to accept off-site food waste, implement a standard operator training requirement for Class I, II, and III facilities, and update requirements for sampling, storage, and use of finished compost and soil amendments.
